QAP (Quality Assurance Program)

The voluntary EPA program for third-party verification of RINs under the Renewable Fuel Standard, established after the 2011–2013 invalid-RIN enforcement actions.

The Quality Assurance Program (QAP) is a voluntary RIN-verification framework established by the U.S. Environmental Protection Agency under 40 CFR 80.1467 to provide an affirmative-defense pathway for obligated parties holding verified RINs. It was created in response to the 2011–2013 enforcement actions involving invalid RINs from biodiesel producers Clean Green Fuel, Absolute Fuels, and Green Diesel, where obligated parties had retired RINs that turned out to be invalidly generated.

Why QAP exists

Before QAP, an obligated party's only protection against an invalid RIN was its own due diligence on the producer. EPA's strict-liability framework under 40 CFR 80.1431 meant that retirement of an invalid RIN could expose the obligated party to enforcement action even where the party had transacted in good faith. The 2014 RFS QAP final rule (79 FR 42078, 18 July 2014) introduced verified Q-RINs and the affirmative defense mechanism that gives obligated parties a clearer compliance posture.

Two QAP options (2014 rule)

The QAP final rule established two QAP options:

  • Option A (Q-RIN) — verified by an independent third party with ongoing facility audits, batch-level review, and continuous monitoring. Q-RINs carry an affirmative defense: if the underlying RIN is later invalidated, the obligated party that retired the Q-RIN in good faith is not liable for replacement.

  • Option B (A-RIN) — verified at a lower-frequency interval. The A-RIN does not carry the same affirmative defense; the obligated party retains some replacement liability if the RIN is later invalidated.

In practice, Option A has been the dominant QAP path since 2014.

Verifier qualifications

QAP independent third-party verifiers must register with EPA, demonstrate the engineering and accounting competencies set out in 40 CFR 80.1469, and follow a verification plan filed with EPA. Periodic facility visits, review of the producer's feedstock procurement records, and reconciliation of EMTS-reported batches against on-site production records are core verification activities.

How QAP shows up in EMTS

When a verified RIN is generated, the producer reports the verification flag through EMTS along with the standard RIN identifier fields. The flag distinguishes Q-RINs from A-RINs from non-QAP RINs. Obligated parties retire RINs through their EMTS account; the verification flag is one of the fields available for review during retirement.

Q-RIN price differential

Public weekly aggregated price data published on EPA's RIN Trades and Price Information page have historically shown a small Q-RIN/non-QAP spread, reflecting the affirmative-defense premium that obligated parties accept for Q-RINs. The spread has narrowed over time as Q-RIN supply has expanded and as obligated-party compliance teams have built confidence in the verification framework.

Historical drivers

The 2011–2013 invalid-RIN cases (Clean Green Fuel, Absolute Fuels, Green Diesel) led to about 140 million invalid RINs and resulted in several years of EPA enforcement actions. The 2014 QAP rule was the regulatory response. Subsequent program updates included clarifications in the 2018 RVO rulemaking and routine verifier registration updates posted on the EPA RFS Quality Assurance website.

QAP scope across D-codes

QAP coverage applies in principle to RINs across all D-codes (D3, D4, D5, D6) but in practice is most heavily used for D4 biomass-based diesel and D6 corn-starch ethanol where the historical invalidation risk was largest. Renewable natural gas D3 RINs from biogas pathways have a different operational profile — pipeline-injection metering and EPA's separate enforcement focus on RNG attribute matching — and the QAP coverage of that segment has evolved through pathway-specific guidance.

Producer perspective

For a biofuel producer, joining QAP means signing a verification-services contract with a registered verifier, opening the production facility to periodic audits, and providing batch-level production records on the verifier's cadence. The producer absorbs the verifier's fee, which is folded into the producer's cost structure. The compensating effect for the producer is broader market access: many obligated parties limit their RIN purchases to Q-RINs to lower replacement-liability exposure.
